On 13th September the Governor telegraphed that
Judgment declared by Full Court on 11th September
declared the orders under section 3 1 (o) and section
6 valid; that on September 12th permission to appeal

to the Privy Council was applied for and granted;
that long delay would thereby be entailed and the
further detention of Nguyen ai quoc. (who is kept
in police custody, not in gaol) for about a year;
that Counsel stated in making his application that
the appeal was made because of the shipping order
under section 6 and suggested its withdrawal by
the Executive and permission to the applicant to
leuve the Colony in his own way. The Foreign
Office was infomed that the Colonial Office now
took the view that the proper course would be for
the Goeernor to withdraw the order made under section
to
6 of the Deportation Ordinance, and ordered Nguyen
ai quo c to leave the Colony within a specified
time.
The Foreign Office were asked whether they
saw any objection to this course, the alternative to
which was to await the results of the appeal to the
Privy Council.
On 25th September the Governor telegraphed that
the request had been received from Nguyen ai quoc for
permission to proceed to England provided it was
found possible to ensure his safety during the voyage
and on arrival; that he was willing to submit to all
reasonable restrictions or conditions which may be
attached to such permission. The Governor pointed

existing order under section 3 1 (o) of the Ordinance
